All photographic images contained throughout our Site are copyright and property of Picaboo Pics, LLC and as such it is illegal for any person to attempt to reproduce them, or use them publicly without prior written permission by Picaboo Pics, LLC. This includes, but is not limited to traditional printing and copying as well as electronic media. The contents of our Site are intended solely for personal, noncommercial use (other than purchase of merchandise from our Site) by the users of our Site.

When you complete a transaction on our Site, we automatically add your e-mail address to certain e-mail distribution lists. These e-mail distribution lists may be used to alert you to new events posted on our Site and to announce special offers. You have the option to remove your e-mail address at any time from e-mail distribution lists by clicking the “unsubscribe” link at the bottom of any e-mail you receive. Any and all photographs taken by photographers for Picaboo Pics, LLC should have been captured by the subject's explicit consent and cooperation. Information Sharing
We are committed to keeping your personal data strictly confidential, and as such our Privacy Policy prohibits us from sharing, renting or selling your personal data with any third party except:

• To provide products or services you have requested
• When we have your permission
• When we provide the information to trusted partners who work on behalf of Picaboo Pics, LLC under confidentiality agreements. These companies will not have any independent right to share your information.

Protecting Your Photos
Your photos are organized are password-protect upon your request. Share your password only with those whom you wish to have access to your photos. Friends and family will then have the ability to add your photos to their personal online photo albums and/or order packages. Further, all enlarged representations of your photos on tour Site are digitally watermarked with “Picaboo” logo embedded directly into the images.

Children
The safety and privacy of children while visiting our Site is one of our primary concerns. Therefore we request that parents assist and supervise minor children while viewing and/or ordering images throughout our Site.

Terms and Conditions

Colors
We have made every effort to display as accurately as possible the colors of the baby photos and products that appear at the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate.

Disclaimer
The photos and materials are provided “as is” without any express or implied warranty of any kind including warranties of merchantability, noninfringement of intellectual property, or fitness for any particular purpose. In no event shall Picaboo Pics, LLC or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of profits, business interruption, loss of information) arising out of the use of or inability to use the materials, even if Picaboo Pics, LLC has been advised of the possibility of such damages. This includes but does not limit to inappropriate use of images by a third party, as well as interruption of services. Because some jurisdictions prohibit the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. Picaboo Pics, LLC further does not warrant the accuracy or completeness of the information, text, graphics, links or other items contained within these materials. Picaboo Pics, LLC may make changes to these materials, or to the products described therein, at any time without notice. Picaboo Pics, LLC makes no commitment to update the Materials.

Guarantee
Every product we offer throughout our Site is fully guaranteed to satisfy you, or we will fully refund the purchase amount, excluding shipping and handling charges. That is our promise to all of our customers. We only request that you contact us within 48 hours of the receipt of unsatisfactory products and return them to us within 7 days of the date when you received the shipment. Please contact contactus@picaboopics.com to obtain additional information on how and where to return the products.

Miscellaneous
We reserve the right to remove or refuse online posting of any images that contain illegal, obscene, lewd or otherwise inappropriate material, or images that infringe on International Copyright Laws or violate privacy of other individuals. Unless otherwise noted, this Site and the contents thereof are displayed solely for the purpose of promoting Picaboo LLC's products and services. This Agreement shall be construed in accordance with the laws of the State of Tennessee, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and federal courts in Shelby County, Tennessee.
